Rules Discussed
- Rule 1.3 General authority of the Court to provide remedies
- Rule 6.14 Appeal from master’s judgment or order
- Rule 7.3 Summary Judgment (Application and decision)
Case Summary
The Defendant and Plaintiff by Counterclaim appealed an Applications Judge’s decision granting the Plaintiff Summary Judgment on a debt claim for unpaid commercial vehicle lease invoices. The Applications Judge did not dismiss the Defendant’s Counterclaim.
The Defendant argued that its defence of set-off and Counterclaim were inextricably linked to the debt claim, and that the matter should not have been resolved on a piecemeal basis. The Plaintiff maintained that Summary Judgment was properly granted and sought dismissal of the Counterclaim.
The Defendant argued that the Appeal should proceed as a hearing de novo because fresh evidence was available, including Undertaking Responses, the hearing transcript, and the resulting Order. Justice Lew held that, pursuant to Rule 6.14, the standard of review was correctness. The Undertaking Responses were not fresh evidence because they were available on the original Application, and the Court records and Order were not evidence.
Justice Lew further held that the Defendant had not established a genuine issue requiring a Trial under Rule 7.3. The Plaintiff proved the governing rental terms, including a right to terminate on 24 hours’ notice, and the Defendant’s conduct demonstrated acceptance of those terms. By contrast, the Defendant’s pleadings relied on unparticularized alternative contractual arrangements that were unsupported by evidence.
The Court held that the Applications Judge erred by failing to dispose of the claim and Counterclaim together. Justice Lew dismissed the Counterclaim pursuant to the Court’s inherent jurisdiction under section 8 of the Judicature Act, RSA 2000, c J-2, and Rule 1.3. Although the Plaintiff had not filed a Cross-Appeal, the Counterclaim was governed by the same facts, evidence, and legal principles as the defence. Requiring a further Application would provide no procedural protection and would only cause additional cost and delay.
The Appeal was dismissed, the Summary Judgment was upheld, and the Counterclaim was dismissed.
