JACKSON v PIIKANI NATION, 2026 ABKB 624
Rules Discussed
- Rule 9.19 Persons who are not parties
Case Summary
This Action was part of case managed litigation (the “Case Managed Actions”). The Applicant submitted a request for a fiat allowing them to file an Originating Application (the “Proposed Action”) against the Respondents to enforce prior Court Orders, among other relief. The Respondents opposed the request on the basis that it failed to comply with the established fiat process and constituted an abusive re-litigation of previously determined issues. Although the fiat request for the Proposed Action failed to comply with the procedural requirements set out in prior Endorsements, Marion J. considered its merits to avoid further delay and consumption of resources.
The Applicant was no longer a party in the Case Managed Actions yet was attempting to enforce “final orders of this Court.” Applying Rule 9.19, Marion J. noted that a non-party may enforce a Court order only if the person obtains an Order or an Order is obtained in that person’s favour. Justice Marion found that the Proposed Action was hopeless as the Applicant failed to identify any Order obtained in his favour. The mere fact that prior judicial findings aligned with the Applicant’s evidentiary position or arguments did not confer standing pursuant to Rule 9.19.
Marion J. reiterated that the Applicant did not require permission of the Court to commence an independent civil action against the Respondents for contractual indemnity or unpaid compensation, making the inclusion of such claims within the Case Managed Actions an abuse of process. In the result, the Court denied the fiat request to file the Proposed Action.
