ST PIERRE ESTATE v BLACK ESTATE, 2026 ABKB 686
Rules Discussed
- Rule 6.14 Appeal from master’s judgment or order
- Rule 7.3 Summary Judgment (Application and decision)
Case Summary
The Plaintiff appealed an Applications Judge’s decision summarily dismissing its claim for negligence pursuant to Rule 7.3. The Plaintiff had previously been granted leave to amend his Statement of Claim to allege negligence against the Defendants. However, the Order granting leave specifically maintained the Defendants’ ability to any defence, including a defence based on limitation periods. The Applications Judge found that the Plaintiff’s claim was statute-barred by the Limitations Act, RSA 2000, c L-12.
Justice Adams reiterated that appeals from Applications Judges’ decisions are reviewed for correctness pursuant to Rule 6.14(3). Therefore, there is no deference to the decision of the Applications Judge. However, the burden remains on the appellant to demonstrate that the decision was incorrect.
The Court found that the Applications Judge was correct in finding that the limitation period for the Plaintiff’s claim had already lapsed for the purposes of the Limitations Act. Further, Adams J. held that a finding that a negligence claim is precluded by the Limitations Act satisfies the test for summary dismissal.
The Court dismissed the Plaintiff’s Appeal.
