FLETCHER v DAVISON & WILLIAMS LLP, 2021 ABQB 842
ROOKE ACJ
9.4: Signing judgments and orders
10.49: Penalty for contravening rules
Case Summary
The Applicant was previously declared a Vexatious Litigant and made subject to expanded Court Access Restrictions. Notwithstanding these measures and explicit instructions from the Court, the Applicant continued to send packages of pseudo-legal documents to Justices of the Court. Associate Chief Justice Rooke had written in a previous Decision that the Applicant was being given a “last warning”.
Given the Applicant’s continued conduct, Rooke ACJ ordered that the Applicant pay $1,000 to the Clerk of the Court as a penalty for contravening the Rules pursuant to Rule 10.49(1).
The Court dispensed with the need for the Applicant’s approval of the Order pursuant to Rule 9.4(2)(c).
