The Appellants appealed a Trial Judge’s award of Costs under s. 39(1) of the Expropriation Act. The Court of Appeal briefly discussed whether the reasonableness standard from former Rule 613 applied to an award of costs under the Expropriation Act. The Court concluded that it did.
