Case Summary

Justice Pentelechuk had previously declined to restore the Applicant’s Appeal after it was struck for failing to meet a filing deadline (the “Initial Decision”). The Applicant sought permission to Appeal the Initial Decision pursuant to Rule 14.5(1)(a). Justice Pentelechuk noted that the present Application was brought more than a month after the Initial Decision and was therefore out of time pursuant to Rule 14.8(2)(a). The Court also held that the Applicant had failed to articulate a basis upon which the Initial Decision should be appealed, and the Application was dismissed. The Court invoked Rule 9.4(2)(c).
